Terms of Service

Effective 2 October 2026

1. Agreement

These Terms of Service govern access to and use of the YourPlan website, software, customer portals and related services. The service is supplied by the YourPlan operator identified in the applicable Order Form, proposal or customer agreement. By creating an account, accepting an invitation, or using the service, you agree to these Terms. If your organisation has a separate signed agreement with YourPlan, that agreement prevails to the extent of any inconsistency.

2. Business use

YourPlan is a business-management platform. A customer is responsible for its users, its portal configuration, the information entered into the service, and ensuring that its use of the platform complies with applicable law and workplace, employment, tax, accounting, privacy and industry requirements.

3. Accounts and access

Users must provide accurate account information, keep credentials confidential, use reasonable security practices and promptly notify YourPlan of suspected unauthorised access. Accounts must not be shared except where a feature is expressly designed for shared access. YourPlan may suspend access where reasonably necessary to protect the service, customer data, users or third parties.

4. Customer data

As between the customer and YourPlan, the customer retains its rights in data it or its users submit to the service. The customer grants YourPlan the rights reasonably necessary to host, process, transmit, back up and otherwise handle that data to provide, secure and support the service. The customer warrants that it has the necessary rights and authority to provide that data.

5. Acceptable use

Users must not use YourPlan to break the law; infringe another person's rights; upload malicious code; probe or bypass security; access another customer's data without authority; overload or disrupt the service; scrape or reverse engineer the service except where law cannot exclude that right; use automated access in a way that materially harms the service; impersonate others; or store highly sensitive information in features not designed for that purpose.

6. Subscription and payment

Subscription pricing, billing frequency, included modules, trial arrangements and any implementation or add-on fees are set out on the applicable Order Form or proposal. Unless otherwise agreed, subscriptions renew for the billing period until cancelled. Fees already earned are not refundable except where required by law or expressly agreed.

7. Changes and availability

YourPlan may improve, replace or modify features over time. We aim to provide a reliable service but do not promise uninterrupted or error-free availability. Planned maintenance, provider outages, internet failures, security events and circumstances outside reasonable control may affect availability.

8. Third-party services

Some features may interact with third-party products or services. Their availability and terms are controlled by those providers. YourPlan is not responsible for a third party's service, but will take reasonable steps to operate integrations that YourPlan provides.

9. Security and privacy

YourPlan will take reasonable technical and organisational measures appropriate to the service to protect customer data. Customers must use the service consistently with the Privacy Policy and must not deliberately submit categories of sensitive or regulated information that YourPlan has not agreed to handle.

10. Intellectual property

YourPlan and its licensors retain all rights in the platform, software, branding, documentation, templates and underlying technology. A paid-up customer receives a non-exclusive, non-transferable right for its authorised users to use the service during the subscription term.

11. Feedback

If a customer or user provides product feedback or suggestions, YourPlan may use that feedback without restriction or payment, provided this does not transfer ownership of the customer's confidential information or customer data.

12. Suspension and termination

A customer may cancel in accordance with its Order Form. YourPlan may suspend or terminate access for material breach, non-payment, unlawful use, security risk or misuse, after reasonable notice where practicable. On termination, access ends and data will be retained or deleted in accordance with the customer agreement, Privacy Policy and applicable law.

13. Consumer and small-business rights

Nothing in these Terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, including rights that may apply under the Australian Consumer Law. Any limitation or exclusion in these Terms operates only to the maximum extent permitted by law.

14. Liability

To the maximum extent permitted by law, each party is responsible for loss to the extent caused by its own breach, negligence or unlawful conduct. YourPlan is not liable for indirect or consequential loss, loss caused by customer configuration or data, unauthorised use of customer credentials, or failures of third-party services outside YourPlan's reasonable control. Any agreed monetary liability cap should be stated in the applicable customer agreement or Order Form rather than implied by this web page.

15. Confidentiality

Each party must protect the other party's non-public confidential information and use it only for the relationship, except where disclosure is authorised or required by law.

16. Changes to these Terms

We may update these Terms for future use of the service. Material changes affecting an existing paid customer will be handled consistently with the applicable customer agreement and applicable law. The current version will be published on this page.

17. Contact

Questions about these Terms can be submitted through the YourPlan Contact page.
